These terms and conditions (together with the information and policies contained in all other customer service pages on the Site and any other documents referred to in these terms and conditions) (the “Agreement") set out the legal terms that apply to your use of our Site and any of its sub-domains and the other services that we provide (the "Services").
Please read this Agreement carefully and make sure that you understand them before using the Services. Please note that by using the Services, you agree to be bound by this Agreement. If you do not accept this Agreement, you will not be able to use the Services and you should leave the Site immediately. If you continue to use the Site or if you order products, we will take this as your acceptance of this Agreement.
The Agreement is only available in the English language. We will not file copies of this Agreement or the contracts between us and you relating to our supply of the Services, or between you and us or the companies and brands that offer or sell products through our Site (our “Partners”) relating to the sale of the products, so we recommend that you print or save a copy of the Agreement for your records (but please note that we may amend this Agreement from time to time so please check the Site regularly, and each time you use the Services to order products, to ensure you understand the legal terms which apply at that time).
When we refer to “Lingble,” "we", "us" or "our", we mean Prospect Field Co. Ltd. and Prospect Field (HK) Company Limited. Where we refer to "you" or "your" we mean you, the person using the Site and the Services.
Lingble provides the Services to you subject to the notices, terms, and conditions set forth in this agreement (the “Agreement”). In addition, when you use any of the Services (e.g., customer reviews, customer support, live chat, blog, etc.), you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such services, and they are incorporated into this Agreement by this reference.
Lingble reserves the right to change this Site and this Agreement at any time.
Customs, Duties and Taxes
You acknowledge and agree that you are solely responsible for any and all duties, import taxes, customs charges and brokerage fees. These are not included in the cost of shipping or handling of your order or the cost of the merchandise itself. Customs, duties, and taxes vary widely from country to country. You are solely responsible for researching and complying with your country's customs and importation requirements. Fraudulent misrepresentation to customs authorities may be illegal and subject to fines or other penalties in your country. Lingble strongly discourages its customers from engaging in any illegal activities. Customs, duty, and taxes are non-refundable. If you refuse a shipment because of unexpected import fees, the cost of the original shipping, any brokerage/customs/duty/taxes, and any return shipping charges will not be refunded. You also acknowledge and agree that you are solely responsible for the provision of shipping information, including any amendments or additions made to shipping labels or documentation made through this website or otherwise. We will not be responsible or liable, directly or indirectly, under any circumstances for any delay, costs, loss or damage of any kind incurred or caused as a result of, or in connection with any misrepresentation, omission, mistake or error (whether fraudulent or unintentional) or any information you have provided or edited in this website for shipping and custom purposes. Any customs duties, taxes, penalties, storage charges or other expenses we incur as a result of the actions of customs or other governmental authorities or your failure and/or the receiver's failure to provide proper shipping information will be charged to you or the receiver of the shipment. In the event that we decide to charge the receiver and the receiver refuses to pay the incurred charges you agree to pay them to us together with our fee for the administration involved as well as any extra costs we will incur. Upon our first request you will provide a proper guarantee for any of the duties, taxes, penalties, storage charges or any other expenses set out in this condition.
Shipping
Although Lingble strives to ship products as soon as possible, there are a number of factors that may delay a shipment, including, among others, delays in sourcing the product from a Partner, delays in shipping from a factory or warehouse outside of Lingble’s control, customs authorities in the country of the recipient, courier delays or unexpected increases in demand on the Site causing a backlog of shipments. You acknowledge and understand that shipping may take longer than any stated estimates on our Site and that our Site provides such estimates solely for convenience and not as guaranteed delivery times. You further acknowledge and agree that by selecting “Priority Shipping” at checkout on the Site (a “Priority Shipment”), your order is only being prioritized in Lingble’s own central dispatch center and not before all the items in your order arrive to Lingble’s central dispatch center. Once all items in a Priority Shipment order have arrived at Lingble’s central dispatch center, Lingble will process any such Priority Shipment before any non-Priority Shipment in the order Priority Shipments were received. Any Priority Shipment is still subject to the same unexpected delays that could affect any other shipment. Selecting Priority Shipping does not guarantee you will receive your order within any prescribed period of time.
Shipping times vary widely from brand to brand and depending on where the items ordered are located. Items with any customization, including silk screening, printing, painting, stitching, hemming, or otherwise, and any made-to-order items require additional time to ship. Note that any estimated shipping dates provided by our customer support team may not be accurate and are not a guarantee by Lingble that such items will ship within the estimated times.
Pre-Shipment Order Changes
You have 24 hours from the moment you place an order until it’s processed by us and shipped. If you wish to change the order prior to it shipping out, you must notify us within those 24 hours. Pre-shipment change requests will not be accepted after 24 hours from the time the order is placed on the Site (i.e., when checkout is completed).
Use of Site
You represent and warrant that you are at least 18 years old or visiting the Site under the supervision of a parent or guardian. Subject to the terms and conditions of this Agreement, Lingble hereby grants you a limited, revocable, non-transferable, and non-exclusive license to access and use the Site by displaying it on your Internet browser only for the purpose of shopping for personal items offered on the Site and not for any commercial use or use on behalf of any third party, except as explicitly permitted by Lingble in advance. Any breach of this Agreement shall result in the immediate revocation of the license granted in this paragraph without notice to you.
Except as permitted in the paragraph above, you may not reproduce, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile, or otherwise exploit this Site or any portion of it unless expressly permitted by Lingble in writing. You may not make any commercial use of any of the information provided on the Site or make any use of the Site for the benefit of another business unless explicitly permitted by Lingble in advance. Lingble reserves the right to refuse service, terminate accounts, and/or cancel orders in its discretion, including, without limitation, if Lingble believes that customer conduct violates applicable laws or is harmful to Lingble’s or its Partners’ interests.
You shall not upload to, distribute, or otherwise publish through this Site any Content, information, or other material that (a) violates or infringes upon the copyrights, patents, trademarks, service marks, trade secrets, or other proprietary rights of any person; (b) is libelous, threatening, defamatory, obscene, indecent, pornographic, or could give rise to any civil or criminal liability under U.S. or international law; or (c) includes any bugs, viruses, worms, trap doors, Trojan horses, or other harmful code or properties. Lingble may assign you a password and account identification to enable you to access and use certain portions of this Site. Each time you use a password or identification, you will be deemed to be authorized to access and use the Site in a manner consistent with the terms and conditions of this Agreement, and Lingble has no obligation to investigate the authorization or source of any such access or use of the Site.
You will be solely responsible for all access to and use of this site by anyone using the password and identification originally assigned to you whether or not such access to and use of this site is actually authorized by you, including without limitation, all communications and transmissions and all obligations (including without limitation financial obligations) incurred through such access or use. You are solely responsible for protecting the security and confidentiality of the password and identification assigned to you. You shall immediately notify Lingble of any unauthorized use of your password or identification or any other breach or threatened breach of this Site's security.
Reviews, Comments and other Content
You may post reviews, comments, photos, videos, and other content; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights (including publicity rights), or otherwise injurious to third parties or objectionable, and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam" or unsolicited commercial electronic messages. You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of any content. Lingble reserves the right (but not the obligation) to remove or edit such content.
If you do post content or submit material, and unless we indicate otherwise, you grant Lingble a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Lingble and sublicensees the right to use the name or Nickname that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Lingble for all claims resulting from content you supply. Lingble has the right but not the obligation to monitor and edit or remove any activity or content. Lingble takes no responsibility and assumes no liability for any content posted by you or any third party. You may request that we remove or edit any information or content that could be reasonably used to personally identify you in accordance with our Privacy Policy.
Copyright
All text, graphics, photographs or other images, button icons, audio clips, and software (collectively, "Content"), belongs exclusively to Lingble or its content suppliers or Partners. The collection, arrangement, and assembly of all content on this Site (the "Compilation") belong exclusively to Lingble. All software used on this Site (the "software") is the property of Lingble or its Software suppliers.
The Content, the Compilation and the Software are all protected international copyright laws. Other logos, slogans, trade names or words are registered trademarks, trademarks, or service marks of Lingble, its suppliers, or third parties. The use of any Lingble trademark or service mark without Lingble's expressly written consent is strictly prohibited. You may not use any Lingble trademark or service mark in connection with any non-Lingble product or service or in any way that is likely to cause confusion. You may not use Lingble's trademarks or service marks in any manner that disparages or discredits Lingble.
You may not use any of the Lingble trademarks or service marks in meta tags without the prior explicit consent of Lingble.
Termination and Effect of Termination
In addition to any other legal or equitable remedies, Lingble may, without prior notice to you, immediately terminate the Agreement or revoke any or all of your rights granted under this Agreement. Upon any termination of this Agreement, you shall immediately cease all access to and use of the Site and Lingble shall, in addition to any other legal or equitable remedies, immediately revoke all password(s), and account identification issued to you and deny your access to and use of this Site in whole or in part. Any termination of this Agreement shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination.
Disclaimer and Limitation of Liability
Except as otherwise provided in the standard terms of sale that govern the same of each product on this site, this site, the products offered for sale on it and the transactions conducted through it are provided by Lingble on an "as is" basis. Lingble makes no representations or warranties of any kind, express or implied, as to the operation of the site or the information, content, materials, or products included on this site except as provided here to the full extent permissible by applicable law, Lingble disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose, noninfringement, title, quiet enjoyment, data accuracy, and system integration. This site may include inaccuracies, mistakes or typographical errors. Lingble does not warrant that the content will be uninterrupted or error free. To the maximum extent permitted by law, Lingble will not be liable for any damages of any kind arising from the use of this site, including, but not limited to, indirect, incidental, punitive, exemplary, special, or consequential damages. To the maximum extent permitted by applicable law, Lingble's total liability to you for any damages (regardless of the foundation for the action) shall not exceed in the aggregate the amount of fees actually paid by you to Lingble during the month immediately preceding the act allegedly giving rise to Lingble's liability.
Order Acceptance
Please note that there may be certain orders that we or our Partners are unable to accept and must cancel. Lingble and our Partners reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being cancelled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order.
Typographical Errors
While Lingble strives to provide accurate product and pricing information, pricing or typographical errors may occur. Lingble cannot confirm the price of an item until after you order. In the event that an item is listed at an incorrect price or with incorrect information due to an error in pricing or product information, Lingble shall have the right, at our sole discretion, to refuse or cancel any orders placed for that item. In the event that an item is priced incorrectly, Lingble may, at our discretion, either contact you for instructions or cancel your order and notify you of such cancellation.
Arbitration
Where the parties fail to settle dispute within 30 days after such dispute occurs, they agree to submit such a dispute to Hong Kong International Arbitration Center (the “HKIAC”) for arbitration which shall be conducted in accordance with the Commission's arbitration rules in effect at the time of applying for arbitration. The arbitral awards are final and binding upon both parties.

Remedies
You agree that Lingble's remedy at law for any actual or threatened breach of this Agreement would be inadequate and that Lingble shall be entitled to specific performance or injunctive relief, or both, in addition to any damages that Lingble may be legally entitled to recover, together with reasonable expenses of any form of dispute resolution, including, without limitation, attorneys' fees.
No right or remedy of Lingble shall be exclusive of any other, whether at law or in equity, including, without limitation, damages injunctive relief, attorneys' fees and expenses.
No instance of waiver by Lingble of its rights or remedies under The Agreement shall imply any obligation to grant any similar, future, or other waiver.
